If it is now impossible to convict the perpetrators of the massacre, it may be and should be possible to prosecute those who were responsible for the failure to convict the mass murderers.
There is a Biblical precedent for this.
The keeper of the prison would forfeit his life if the prisoner or prisoners he was responsible for escaped.
Acts 16:27
And the keeper of the prison awaking out of his sleep, and seeing the prison doors open, he drew out his sword, and would have killed himself, supposing that the prisoners had been fled.
